These Terms of Service govern your use of the 365Digital website and any services, demos, landing pages, wallet-card campaigns, or related marketing work provided by 365Digital. By using our website or engaging our services, you agree to these terms.
Services
365Digital provides marketing strategy, landing pages, wallet pass experiences, campaign setup, demo pages, customer capture workflows, nurture campaigns, and related implementation services.
Specific deliverables, timelines, fees, approvals, and responsibilities may be described in a separate proposal, invoice, statement of work, or written agreement.
Client Responsibilities
Clients are responsible for providing accurate business information, campaign details, offers, brand assets, approvals, and any required legal or compliance guidance for their industry.
Clients are also responsible for ensuring that their offers, advertisements, claims, promotions, privacy practices, and customer communications comply with applicable laws and platform rules.
Demos and Personalized Examples
365Digital may create personalized demo pages to illustrate how a campaign could work for a business. Demo pages are for preview, sales, and strategy purposes unless a business approves production use.
Businesses should review and approve all copy, images, offer details, links, and campaign mechanics before any public campaign is launched.
Third-Party Tools
Our services may rely on third-party platforms such as hosting providers, wallet pass systems, analytics tools, CRM systems, email or SMS platforms, ad platforms, POS systems, booking tools, or automation software.
365Digital is not responsible for outages, policy changes, fees, data handling, or limitations of third-party platforms.
Payments and Fees
Fees, billing schedules, setup costs, subscriptions, or retainers will be described in the applicable proposal, invoice, or written agreement. Unless otherwise stated, fees are due according to the payment terms provided at the time of engagement.
Intellectual Property
365Digital retains ownership of its underlying methods, templates, systems, code patterns, strategy frameworks, and reusable materials. Clients retain ownership of their own brand assets, logos, product information, and content they provide.
Upon full payment, clients receive the agreed rights to use final deliverables created specifically for them, subject to any third-party licensing limits.
No Guaranteed Results
365Digital works to improve customer capture, campaign measurement, and follow-up. However, results depend on offer quality, traffic, audience, business operations, pricing, market conditions, follow-up, and other factors outside our control. We do not guarantee specific revenue, profit, redemption, or advertising results unless expressly stated in a written agreement.
Limitation of Liability
To the maximum extent permitted by law, 365Digital will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.
Our total liability for any claim related to the services is limited to the amount paid to 365Digital for the specific service giving rise to the claim.
